Internationally-Recognized Individual Athletes

Scenario

Internationally-Recognized Individual Athletes

You must be coming to the United States to participate in a specific athletic competition in a sport in which you are internationally recognized. Your achievement must be renowned, leading, or well-known in more than one country, and the competition(s) must have a distinguished reputation at an internationally recognized level of performance.

Internationally-Recognized Athletic Teams

Scenario

Internationally-Recognized Athletic Teams

You must be coming to the United States to participate in an athletic competition with a team that, as a unit, has achieved international recognition in the sport. The competition must have a distinguished reputation and require the participation of an internationally recognized athletic team.

International Collegiate Student-Athletes (Graduating / Recently Graduated)

Scenario

International Collegiate Student-Athletes (Graduating / Recently Graduated)

The P-1A classification can apply to international collegiate student-athletes who represented their countries in international competition or who achieved outstanding success while competing for their colleges or universities, individually or as part of an athletic team.

Amateur Athletes or Coaches

Scenario

Amateur Athletes or Coaches

You must be coming to the United States to perform as an athlete or coach as part of a team or franchise located in the U.S. and a member of a foreign league or association. The foreign league or association must meet the following requirements:

  • The league or association must consist of 15 or more amateur sports teams.
  • Participation must make players temporarily or permanently ineligible under NCAA rules to earn a scholarship in the sport at a U.S. college or university, or participate in the sport at a U.S. college or university.
  • The league or association must be the highest level of amateur performance of that sport in the relevant foreign country.
  • A significant number of individuals in the league are drafted by a major sports league or a minor league affiliate.

We File the Petition

File Form I-129 with USCIS

Form I-129, Petition for Nonimmigrant Worker is filed with USCIS to get permission for the athlete to apply for the P-1 visa. The petition must be filed no more than 6 months before the scheduled performance and the appropriate fee must be paid.

Getting the Visa

Apply at a U.S. embassy abroad

Once the petition is approved, you must apply for the actual visa at an American Embassy abroad. Provide a copy of the Notice of Action (Form I-797) and complete Form DS-160 to schedule the interview.
